CPSC eFiling Rule Moves Toward Implementation

It’s still seven months away, but the Consumer Product Safety Commission (CPSC) on July 8 will begin requiring that certificates of compliance must be electronically filed, reminds DHS in a newsletter.

CPSC oversee various consumer products. For certain products, parties must certify the product meets all applicable consumer product safety standards and generate a certificate of compliance.

Currently, companies are not required to preemptively file their certificates of compliance with the CPSC. Instead, the certificates must be provided upon request the CPSC or by U.S. Customs and Border Protection (CBP) at time of entry.

In 2023, the CPSC initiated the CPSC eFiling initiative that will require importers to electronically file data from the certificates of compliance as part of the Customs entry. The initiative aims to improve product safety by enhancing risk assessment and enforcement at ports of entry. Importers will be required to provide information such as the product’s identification, certification details, and manufacturing and testing records when filing an entry.

The eFiling program’s pilot phase started in late 2023 and moved to a voluntary stage earlier this year. The eFiling requirement will become mandatory on entries into the U.S. starting July 8, 2026.

Parties can file their certificates in advance with the CPSC via their eFiling product registry. If that is done, on entries of the product, a three-data element message set (certifier ID, product ID, version ID) will be required to be submitted as part of the Customs entry.

If a product’s certificate has not been filed through the product registry, then a larger seven-data element date set will be required to be submitted on the Customs entry.

If not done so already, it his highly recommended that parties who import consumer products requiring certificates of compliance begin preparing and establishing a process on how they will manage this new requirement, according to DHL.

Parties may begin voluntarily filing their certifications and submitting the required data on their entries. By doing so, it will allow time to work out any identified issues and ensure all is smoothly running before the requirement becomes mandatory.
